dc.description.abstractEl secreto médico es un deber ético fundamental en la práctica clínica, orientado a proteger la autonomía, intimidad y la confianza de pacientes. No obstante, en Chile este principio no es absoluto y contiene excepciones cuando entra en conflicto con la salud pública, la protección de menores o el riesgo grave para terceros, conforme lo establecido en la Ley Nº20.584 y otras normativas vigentes. Este articulo analiza el conflicto bioético que surge entre el deber de confidencialidad y la obligación de prevenir daños, examinando los criterios que justifica limitar el secreto médico desde una perspectiva de proporcionalidad. La reflexión se apoya en los principios de autonomía, beneficencia, no maleficencia y justicia, proponiendo un equilibrio razonado entre el respeto a los derechos del paciente y el bienestar colectivo. Se concluye que el secreto médico debe ser resguardado como regla general, pero limitado de manera justificada en situaciones excepcionales. Medical confidentiality is a fundamental ethical duty in clinical practice, aimed at protecting patients' autonomy, privacy, and trust. However, in Chile, this principle is not absolute and includes exceptions when it conflicts with public health, the protection of minors, or serious risk to third parties, as established in Law No.20.584 and other applicable regulations. This article analyzes the bioethical conflict that arises between the duty of confidentiality and the obligation to prevent harm, examining. The criteria that justify limiting medical confidentiality from a perspective of proportionality. The analysis is based on the principles of autonomy, beneficence, non-maleficence, and justice, proposing a reasoned balance between respect for patients' rights and collective well-being. It concludes that medical confidentiality should be protected as a general rule but justifiably limited in exceptional situations.
